Amendments to legislation and Tribunal Rules
A number of legislative changes have been made in the form of regulations that amend or add to our existing First-tier Tribunal for Scotland Housing and Property Chamber (Procedure) Regulations 2017(“the Tribunal Rules”) and also some of the primary legislation that Applications can be made under. These changes are due to come into force over the next few weeks.
We will be publishing detailed updates as each set of regulations commences, but in the meantime, we have listed the legislation coming into force, and their commencement dates.
Please be aware that some of these regulations are still in draft form and are awaiting final approval and publication:
The First-tier Tribunal for Scotland Housing and Property Chamber (Procedure) Amendment Regulations 2018: Commences 20th February 2019 (with selected amendments commencing on 6 March 2019)
These regulations make changes to the Tribunal Rules, and further information on these changes will be issued at commencement.
The Housing (Scotland) Act 2006 (Modification of the Repairing Standard) Regulations 2019: commences 1 March 2019 (only selected amendments will be effective from 1 March 2019 with other changes taking place in 2021, 2024 and 2027)
The Housing (Scotland) Act 2006 (Supplemental Provision) Order 2019: commences 1 March 2019
These regulations make amendments to the Housing (Scotland) Act 2006, which is the primary legislation that the Tribunal uses when dealing with applications about the Repairing Standard. A further update will be issued around the commencement date of 1 March.
The First-tier Tribunal for Scotland Housing and Property Chamber (Incidental Provisions) Regulations 2019: commences 6 March 2019
These regulations make amendments to other primary legislation, to complement the updates to the Tribunal Rules. A Further article will appear by 6 March highlighting the changes.
In all cases, where the regulations require new or updated guidance or forms to be made available on the website, these updates will be published at the same time as the relevant news article.
